Welcome to FootLove! These Terms of Service ("Terms", "Agreement") govern your access to and use of FootLove's website, mobile applications, and services (collectively, the "Platform") operated by FootLove ("Company", "we", "us", or "our"). By accessing or using the Platform, you agree to be bound by these Terms and our Privacy Policy.

1. Acceptance of Terms

By creating an account or using our Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Platform.

2. Eligibility and Age Verification

You must be at least 18 years old to use this Platform. All users are required to complete age verification through our third-party verification service (SumSub) before accessing platform features. By using the Platform, you represent and warrant that:

• You are at least 18 years of age
• You have the legal capacity to enter into this Agreement
• You will provide accurate and complete information during registration and verification
• You will maintain the security of your account credentials

3. Platform Description and Services

FootLove is a platform that connects buyers and sellers of foot-related content including photos and videos. The Platform facilitates transactions through a virtual currency system ("Coins") and provides messaging capabilities between users.

4. Content Policies and Prohibited Content

To comply with applicable laws and maintain a safe environment, the following content is strictly prohibited:

• Nudity or sexually explicit content (NSFW)
• Content depicting or involving minors in any capacity
• Content that promotes prostitution, escort services, or sexual services
• Illegal content or content that promotes illegal activities
• Harassment, bullying, or hate speech
• Spam or unauthorized commercial content
• Content that violates intellectual property rights
• Content that promotes violence or harmful activities

All content is subject to automated moderation using Hive AI technology and manual review. We reserve the right to remove content that violates these policies without prior notice.

5. FOSTA-SESTA Compliance

In compliance with the Fight Online Sex Trafficking Act (FOSTA) and Stop Enabling Sex Traffickers Act (SESTA), we strictly prohibit any content or communications that promote or facilitate prostitution or sex trafficking. Users found to engage in such activities will be immediately banned and reported to authorities as required by law.

6. User Content and Intellectual Property

By uploading content to the Platform, you represent that you own all rights to the content or have obtained all necessary permissions. You grant FootLove a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, and distribute your content solely for the purpose of operating and promoting the Platform. You retain ownership of your content.

7. Virtual Currency and Payments

The Platform uses a virtual currency system ("Coins") for transactions. By using our payment services, you agree that:

• All purchases of Coins are final and non-refundable
• Coin values and exchange rates are subject to change
• You will pay all applicable fees and taxes
• You authorize us to charge your chosen payment method
• We use PCI-compliant payment processing systems

8. Subscription Services and Cancellation Policy

FootLove may offer subscription-based services that involve recurring billing. For any subscription purchases:

• Subscriptions will automatically renew at the end of each billing period
• You will be charged the then-current subscription fee unless you cancel
• Subscription fees are billed in advance for each billing period
• All subscription fees are non-refundable once charged

Cancellation Policy: You may cancel your subscription at any time to prevent future recurring charges. To cancel your subscription:

• Self-Service Cancellation: Log into your account and cancel through your subscription settings
• Email Cancellation: Contact us at anna@joinfootlove.com with your cancellation request
• CCBill Support: For payments processed through CCBill, you may also contact CCBill's Consumer Support department at https://support.ccbill.com/

Important: Cancellations must be made before your next billing date to avoid being charged for the next period. Once cancelled, you will retain access to subscription features until the end of your current billing period. No partial refunds will be provided for unused portions of subscription periods.

9. Privacy and Data Protection

We process personal data in accordance with our Privacy Policy and applicable data protection laws including GDPR and CCPA. Key points include:

• We collect only necessary personal information
• We implement appropriate security measures
• You have rights to access, correct, and delete your data
• We do not sell personal information to third parties
• We retain data only as long as necessary for our services

10. Data Subject Rights (GDPR/CCPA)

If you are located in the EU, UK, or California, you have additional rights regarding your personal data:

• Right to Access: Request copies of your personal data
• Right to Rectification: Correct inaccurate personal data
• Right to Erasure: Request deletion of your personal data
• Right to Data Portability: Receive your data in a structured format
• Right to Object: Object to certain processing activities
• Right to Restrict Processing: Request limitation of processing

11. Account Termination and Data Deletion

You may delete your account at any time through the settings page. Upon account deletion:

• Your personal information will be removed from active databases
• Your profile will be anonymized
• Content may be retained for legal compliance purposes
• Some data may remain in backup systems for a limited period
• We will cancel any active subscriptions

12. Content Pre-Screening and Moderation

Mandatory Pre-Screening Process: All user-uploaded content must undergo a comprehensive review process before publication to ensure compliance with legal requirements and platform standards. This pre-screening process includes:

• Automated Review: Initial screening using Hive AI technology to detect prohibited content
• Manual Review: Human moderation review by trained staff before content goes live
• Legal Compliance Check: Verification that content does not violate applicable laws including FOSTA-SESTA, age verification requirements, and intellectual property laws
• Platform Standards Review: Confirmation that content meets our community guidelines and terms of service
• Age Verification Confirmation: Verification that all persons depicted in content are verified adults (18+)

Content will only be published after successful completion of the pre-screening process. Content that fails review will be rejected with explanation provided to the user. Users may appeal content decisions through our support channels.

Published content remains subject to ongoing monitoring and may be removed if found to violate our standards after publication.

Users can report inappropriate content that may have bypassed our pre-screening process through:

• Platform reporting tools

14. Platform Rules and Community Guidelines

Users must comply with all platform rules including:

• Providing accurate information during registration
• Maintaining account security
• Respecting other users' rights and privacy
• Not attempting to circumvent platform features or security
• Not engaging in fraudulent or deceptive practices

15. International Compliance

Users accessing the Platform from outside the United States are responsible for compliance with local laws. The Platform is not available in jurisdictions where such services are prohibited by law.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FOOTLOVE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATING TO YOUR USE OF THE PLATFORM.

17. Indemnification

You agree to indemnify and hold harmless FootLove from any claims, damages, losses, or expenses arising from your use of the Platform, violation of these Terms, or infringement of any rights of another party.

18. Governing Law and Dispute Resolution

These Terms are governed by the laws of Sweden. Any disputes will be resolved through binding arbitration in accordance with the rules of the Arbitration Institute of the Stockholm Chamber of Commerce.

19. Cookie Policy

We use essential cookies for platform functionality and analytics. By using the Platform, you consent to our use of cookies as described in our Privacy Policy.

20. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated through email or platform notifications. Continued use after changes constitutes acceptance of the new Terms.
